This article outlines one of the most misunderstood, and arguably pernicious, ways in which our current economic structure may be undermining the innovation that Fusion Era growth depends on. It appears from this data (note: I haven't read the full report yet), that using noncompete agreements to protect a company's supposed IP damages the larger economy in a variety of ways, from suppressing new business starts to inhibiting hiring for fear of running afoul of an NCA.
Surprisingly, and perhaps most disturbingly, this impact falls disproportionately on minority and female employees, whose lower net worth the lower value of future positions they may be competing for may make challenging an NCA more difficult.
This is a problem for all of us, and I think the FTC and the few states that have banned these agreements are going in the right direction. While there may be a small number of cases where an NCA specific to a certain piece of IP, might make sense, these agreements are far too often applied blanket-style, prevent people from being able to seek new opportunities.
Fusion era businesses are going to have to deal with a higher level of information transparency than conventional thinking about "trade secrets" permits - both because they have more need for human innovation than ever, and because technology makes hiding those secrets nearly impossible.
